1. Agreement

These Terms & Conditions (“Terms”) govern your use of the website lawayraretreat.com, your booking of any retreat or service offered by LaWayra Retreat (“LaWayra,” “we,” “us,” or “our”), and your participation in any LaWayra program (collectively, the “Services”). By booking a retreat, completing a payment, or otherwise using the Services, you agree to these Terms and to our Privacy Policy.

If you do not agree, please do not book or use the Services.

2. Eligibility

You must be at least 18 years old to book a retreat or use the Services. By booking, you confirm that you are 18 or older and have the legal capacity to enter into a binding agreement.

3. Booking, Deposits & Payments

• Reservation: A booking is confirmed only after we receive a non-refundable deposit (or full payment, depending on the package selected) and send written confirmation.
• Balance: Any remaining balance is due by the date specified in your booking confirmation. Failure to pay the balance by the due date may result in cancellation of your reservation without refund of the deposit.
• Pricing: All prices are quoted in U.S. dollars unless otherwise stated. Prices may change without notice; the price applicable to your booking is the price confirmed at the time you pay.
• Payment methods: Payments are processed by third-party providers (such as BookingLayer and Stripe). You agree to their terms when paying.
• What’s included: The inclusions of your retreat (accommodation, meals, ceremonies, transport, activities) are listed in your booking confirmation and on the retreat’s product page at the time of booking.

4. Cancellation & Refunds

By you (the guest)

• Deposits are non-refundable. If you cancel for any reason, you forfeit your deposit.
• Cancellations 60+ days before arrival: Balance paid (above the deposit) is refundable, minus any third-party fees already incurred (transport, special arrangements).
• Cancellations 30–59 days before arrival: 50% of the balance paid (above the deposit) is refundable.
• Cancellations less than 30 days before arrival: No refund.
• No-shows or early departure: No refund, partial or otherwise.
• Date changes: One date change is permitted at no charge if requested at least 45 days before arrival, subject to availability. Subsequent changes or changes inside 45 days may incur an administrative fee of up to $150 USD.

By LaWayra

• If we cancel a retreat for reasons within our control (e.g., insufficient bookings), you may choose between a full refund or a credit toward a future retreat of equal value.
• If we cancel due to force majeure (see Section 13), we will offer a credit toward a future retreat. Refunds in these cases are at our discretion and may exclude non-recoverable third-party costs.

5. Health, Safety & Medical Disclosure

Our retreats involve ceremonial use of sacred plant medicine, group integration work, physical activities, and time in a remote location. They are not appropriate for everyone.

• Honest disclosure required: Before your retreat, you must complete our health intake and disclose all medical conditions, medications, supplements, mental-health history, and recent substance use. Withholding or falsifying information may result in being declined participation without refund.
• Contraindications: Certain conditions (including but not limited to cardiovascular disease, severe psychiatric conditions, current SSRI/SNRI/MAOI use, and pregnancy) may make participation unsafe. Our team will review your intake and may decline your participation on safety grounds.
• Not medical treatment: LaWayra is not a medical or psychiatric facility. We do not diagnose, treat, or cure any illness. Information shared by our team is not medical advice.
• Consult your doctor: You are responsible for consulting your own physician before attending. You participate at your own risk.
• Right to remove a guest: We reserve the right to deny or revoke participation if, in our reasonable judgement, your continued participation poses a risk to yourself, other guests, staff, or the integrity of the program. No refund will be issued in such cases.

6. Code of Conduct

By attending a retreat, you agree to:

• Treat staff, facilitators, indigenous shamans, and other guests with respect.
• Follow the safety instructions of the LaWayra team at all times.
• Refrain from bringing or using illegal drugs, recreational substances, or alcohol on the property.
• Respect the privacy of other guests — no photographing or recording of others without their explicit consent, and no recording of ceremonies.
• Maintain confidentiality about the personal sharing of other guests.

Violations may result in immediate removal from the retreat without refund.

7. Assumption of Risk

You acknowledge that participation in a LaWayra retreat involves inherent risks, including but not limited to emotional and psychological effects of ceremonial work, physical strain, travel risks, and the unpredictability of working with sacred medicine. You voluntarily accept these risks and participate at your own discretion.

8. Limitation of Liability

To the maximum extent permitted by law:

• LaWayra, its owners, staff, facilitators, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your booking or participation.
• Our total aggregate liability to you, for any claim arising out of or related to the Services, is limited to the amount you actually paid LaWayra for the retreat in question.
• Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for gross negligence, fraud, or wilful misconduct).

9. Indemnification

You agree to indemnify and hold harmless LaWayra and its team from any claims, damages, costs, or expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of any law, or your participation in a retreat to the extent caused by your own act or omission.

10. Intellectual Property

All content on lawayraretreat.com — text, images, videos, logos, brand marks, and design — is owned by LaWayra or its licensors and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent, except for personal, non-commercial use of publicly shared content.

11. User-Generated Content

If you submit reviews, testimonials, photos, or other content to us (by email, social media tag, or otherwise), you grant LaWayra a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify, and display that content for marketing and educational purposes. You confirm that the content is yours to share and doesn’t violate anyone else’s rights.

12. Marketing & Communications

By booking with us or filling in a form on our site, you agree we may contact you with transactional messages (booking-related) and, where you’ve opted in, marketing messages about upcoming retreats, events, and integration content. You can unsubscribe from marketing at any time.

13. Force Majeure

LaWayra is not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, pandemics, government action, travel restrictions, civil unrest, strikes, utility failures, or other force-majeure events. In such cases, we will work in good faith to reschedule your retreat or offer a credit.

14. Third-Party Services

The Services rely on third-party providers (BookingLayer, Stripe, GoHighLevel, Google, Meta, and others). We are not responsible for the acts, omissions, or downtime of those providers. Your use of any third-party service is subject to that provider’s terms and policies.

15. Modifications to the Services or Terms

We may modify these Terms or the Services at any time. Material changes will be posted on this page with an updated “Last updated” date. For active bookings, the Terms in force at the time of booking will continue to apply unless we and you agree otherwise in writing.

16. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Colombia, without regard to conflict-of-law rules. Any dispute arising out of or related to these Terms or the Services will be resolved first by good-faith negotiation. If negotiation fails, the dispute will be submitted to the competent courts of Medellín, Antioquia, Colombia, unless mandatory consumer-protection law in your country of residence provides otherwise.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with your booking confirmation and our Privacy Policy, constitute the entire agreement between you and LaWayra and supersede any prior agreements relating to the same subject matter.
